By accessing or using this website (the “Site”) and purchasing our products, you agree to these Terms. If you do not agree, please do not use the Site.
1) Overview
Welcome to OptimalPep (“we,” “us,” “our”). By accessing or using this website (the “Site”) and purchasing our products, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you must not access or use the Site or purchase our products.
2) Eligibility & Accounts
- You represent and warrant that you are at least 18+ and legally capable of entering into binding agreements.

You agree to provide accurate, current, and complete information and to maintain the security of your account credentials. We reserve the right to refuse or cancel orders, suspend or terminate accounts, or restrict access to the Site in cases of suspected fraud, misuse, misrepresentation, or non-compliance with these Terms.
3) Research-Use Only (Critical)
- All products are for research and laboratory use only, unless explicitly stated otherwise in writing.
- Products are not for human or animal consumption, drug use, diagnostic use, clinical use, or incorporation into food, cosmetics, or medical devices.
- You are solely responsible for proper handling, storage, usage, and disposal of all products in accordance with applicable Safety Data Sheets (SDS/MSDS), Certificates of Analysis (COA), institutional policies, and all applicable laws and regulations.
Statements made on the Site have not been evaluated by the U.S. Food and Drug Administration (FDA) or any regulatory authority.
4) Ordering, Pricing & Availability
- Product listings, specifications, pricing, and availability are subject to change without notice. We reserve the right to limit quantities, discontinue products, or cancel orders at our discretion.
- While we strive for accuracy, errors may occur, including typographical, pricing, or system-related inaccuracies. We reserve the right to correct such errors and cancel affected orders, with notice provided where practicable.
- Lot-to-lot variations may occur within accepted analytical tolerances. COAs and testing documentation apply to the specific lot shipped.
5) Payments, Taxes & Chargebacks
- Payments are processed securely through third-party payment processors. OptimalPep does not store full payment card details.
- All prices are listed in U.S. Dollars (USD) unless otherwise stated. You are responsible for all applicable taxes, duties, or fees unless collected at checkout.
- Fraudulent payment activity or misuse of chargebacks may result in account suspension and investigation. We reserve the right to contest improper chargebacks.
6) Shipping & Risk of Loss
- We aim to process and ship orders promptly. Delivery timelines are estimates and may vary due to carrier delays, weather, holidays, or customs processes.
- Risk of loss and title transfer to you upon acceptance of the shipment by the carrier. Shipping insurance is recommended where available.
- You are responsible for providing an accurate shipping address. OptimalPep is not responsible for delays, losses, or additional costs resulting from incorrect address information or carrier-related issues.
- International Orders:
- You are responsible for all import permits, duties, taxes, and compliance with local regulations. OptimalPep is not liable for customs delays, seizures, holds, or destruction of shipments.
7) Inspection & Acceptance
- You must inspect all shipments upon receipt. Any claims for damage, shortages, or incorrect items must be reported within three (3) business days of delivery, including photographs and order details.
- Failure to report issues within this timeframe constitutes acceptance of the order.
8) Returns & Refunds
Due to the nature of research and laboratory products, all sales are final. Returns, exchanges, or refunds are not permitted once an order has been placed.
9) Limited Warranty & Disclaimers
- OptimalPep warrants that, at the time of shipment, products will conform to the specifications applicable to the corresponding lot.
- Your exclusive remedy for breach of this warranty is, at OptimalPep’s option, replacement of the affected product or refund of the purchase price for that product.
- Disclaimer: Except as expressly stated above, all products are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
10) Limitation of Liability & Indemnification
- To the fullest extent permitted by law, OptimalPep shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.
- Our total liability for any claim arising out of or relating to a product purchase shall not exceed the amount paid for the product giving rise to the claim.
- You agree to indemnify and hold harmless OptimalPep from any claims, liabilities, damages, or expenses arising from your handling, storage, use, resale, or violation of these Terms.
11) Bundles, Quantities & Promotions
- Bundle pricing applies only to designated bundle products. Purchasing multiple individual units does not qualify for bundle pricing unless the specific bundle SKU is added to the cart.
- Discounts and promotional offers may not be combined unless expressly stated and may be modified or discontinued at any time.
12) Site Use, Content & Intellectual Property
- All content on the Site, including text, graphics, logos, product images, documentation, and COAs, is owned by or licensed to OptimalPep and protected by applicable intellectual property laws.
- You may not copy, reproduce, scrape, frame, reverse-engineer, or use automated tools to extract Site content without prior written consent.
- User-submitted reviews or content must be lawful and non-infringing. By submitting content, you grant OptimalPep a non-exclusive, royalty-free license to use and display such content.
13) Compliance, Resale & Export
- You are responsible for compliance with all applicable local, state, federal, and institutional laws regarding the purchase, possession, use, resale, transport, and disposal of products.
- You agree not to export or re-export products in violation of U.S. export control or sanctions laws.
14) Governing Law & Disputes
- These Terms are governed by and construed in accordance with the laws of the United States and the State of Florida, without regard to conflict-of-law principles.
- Exclusive venue for any dispute shall be the state or federal courts located within the State of Florida, and you consent to their jurisdiction.
15) Changes, Severability & Assignment
- We may update these Terms at any time by posting the revised version on the Site with an updated “Last Updated” date.
- If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.
- We may assign our rights and obligations under these Terms. You may not assign without our prior written consent.
16) Mobile Terms of Service

The OptimalPep mobile message service (the “Service”) is operated by OptimalPep (“OptimalPep”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to OptimalPep’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of OptimalPep through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with OptimalPep. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18338056982 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other OptimalPep mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
